Industrial Court orders immediate payment of US$22,745 to former Staff

Hon. Justice Isaac Essien of the Lagos Judicial Division of the National Industrial Court has ordered News Central Limited to pay one Rebecca the sum of N US$22,745.69 (Twenty-Two Thousand, Seven Hundred and Forty-Five Dollars, Sixty-Nine Cents) being an unpaid entitlement claim upon the termination of Rebecca's employment.


The Court ordered that the judgment sum awarded to Rebecca be paid forthwith upon the service of the judgment order on News Central Limited, with the sum of N200,000 as the cost of action.


From facts, the claimant, Rebecca had sought all her entitlements totalling the sum of US$22,745.69 (Twenty-Two Thousand, Seven Hundred and Forty-Five Dollars, Sixty-Nine Cents) plus interest on the said sum against the News Central, amongst others.


However, despite service of the Court processes, News Central Limited did not file any defence to the action. 


The Rebecca’s counsel, U. E. Onwuka Esq applied for summary judgment and sought for an order of the Honourable Court entering Judgment in the sum of US$22, 745.69 (Twenty-Two Thousand, Seven Hundred and Forty-Five Dollars, Sixty-Nine cents) on the ground that the News Central Limited does not have any defence to the Claim having unequivocally admitted its indebtedness and therefore there are no triable issues in the suit among others.


The learned counsel argued that News Central Limited has wilfully failed and refused to pay its client in spite of the several demands made to the firm, and urged the Court to grant the relief sought.


In a well-considered judgment, the Presiding Judge, Justice Isaac Essien, held that the Rules of the Court empower the court to enter summary judgment where the claimant believes that there is no defence to the claim, and where it appears to the Court that a party does not have a good defence.


The Court ruled that Rebecca is entitled to the sum claimed and entered judgment in favour of Rebecca.
