Industrial Court Restrains Academic Staff Union of Polytechnic From Embarking On Strike In Bida Poly

Abuja --His Lordship, Hon. Justice Sanusi Kado of the National Industrial Court of Nigeria, Sitting in Abuja has granted an interim injunction, restrained Academic Staff Union of Polytechnic & five others from embarking on any strike or lockout in Federal Polytechnic, Bida, Niger State pending the hearing and determination of the motion on notice with the substantive suit.

 

The court held that if the proposed strike is allowed, it will jeopardize academic activities and the future of thousands of student in the institution, ordered that processes be served on the defendants, and adjourned hearing to 2nd May 2019.

 

In an ex-parte motion filed Dr.  Abubakar Abdul Ozukogi (Rector,Federal Polytechnic, Bida Niger State) against Academic Staff Union of Polytechnic ASUP & five others, the facts from the affidavit in support is that sequel to the re-appointment of the Dr.  Abubakar Abdul Ozukogi as Rector again for another term of 4years that the Academic Staff Union of Polytechnic ASUP & five others -defendants engaged in holding several meetings with the aim of disrupting academic and administrative activities of the Federal Polytechnic, Bida.

 

After carefully appraising the facts and circumstance that led to the institution of the motion, His Lordship, Hon. Justice Sanusi Kado held there is deposition in the affidavit that if strike/lockout takes place it will jeopardize academic activities and the future of thousands of student in the institute.

 

“This court is not only a court of law but a court of equity. If this application is not granted and the strike/lockout is embarked upon as threatened. The future of thousands of students will be affected as their graduation may be delayed; the strike/lockout, if allowed to take place, will also affect even the parents of the students as they would have to struggle to make arrangement of transportation of their wards back to their houses.

 

“In view of the urgency, it is hereby ordered that an order of interim injunction is hereby granted restraining the defendants acting by themselves or through their agents, privies, cohorts, colleagues or in any other manner whatsoever from embarking on any strike or lockout in Federal Polytechnic, Bida, Niger State pending the hearing and determination of the motion on notice already filed by the applicants along with the substantive suit.”

 

The court ordered that processes and motion on notice for interlocutory injunction be served on the defendants, and adjourned hearing to 2nd May 2019.
