[Extra] Katsina Limitation Law no longer applicable for Salaries Claim ---Industrial Court Rules

The Presiding Judge of the National Industrial Court, Kano Judicial division, His Lordship, Hon. Justice E. D. Isele has dismissed the preliminary objection filed by Governor of Katsina State and 2 others in a matter brought by Mr. Bature Dutsin-Ma challenging his alleged disengagement as Permanent Commissioner Katsina State Independent Electoral Commission and payment of entitlements among others.


The defendants-State Governor and others filled an objection that the court cannot entertain the matter on the ground that the Mr. Bature approached the court for redress 120 days against the 3 months window accepted by the Public Officers (Protection) law of Katsina State, urged the court to dismiss the case.


In reply, the counsel to the claimant Uyi Igunma, Esq submitted that the action is not statute-barred urged the court to dismiss the objection in its entirety.


Delivering the ruling after careful evaluation of the submissions of both counsel, the trial Judge, Justice Isele held that the case of none payment of outstanding salaries, is one that Public Officers Protection Law would not apply as it is one of continuance of injury or damage, dismissed the objection for lacking merit, ordered the matter proceed to hearing.
